L. Barnes & E. A Bedell Esqurs and Anthony Barkman whose name was to the affidavit upon which the writ was issued was sworn.Upon investigation it appeared that the witness had been suborned had signed & sworn to two affadavits written by George Backman, he did not know any of the defendants named, had sworn to to both affidavits upon reports & was decieved is sorry for what he had done &cThere being no cause of action what ever the Court discharged the defendants.the writs were issued by E. F. Smith, Capt of the Carthage Greys and was in command at the time Joseph & Hyrum was m
artered.After we were discharged we went back to
the shiriffs office and after some arrangements with the sheriff we prepared to come home.When we had come about four or five miles from Carthage we met an express, Br. C. Lott, by which we were informed that a Committee of the Citizens of Quincy had arrived in Nauvoo "requesting us to communicate in writing our disposition and intention at this time, particularly with regard to moving to some place where the peculiar organization of our church will not be likely to engender so much strife and contention a so unhappily exhists at this time in Hancock & some of the adjoining counties."We all drove up near to President B. Young and heard the report as above and then proceeded on our way home where we arrived about 6 o clock a black set of men as it was a very warm & dusty day and our faces looked like we were painted black.We drove up on the parade ground before my marquee and Genl Young addressed them in a short speech thankin
g those who had attended usand then the croud
dispersed.I then washed my self and took supper and then went with J. D. Hunter and A. McRae to Lanthrops store and took up some goods and then returned to my marquee about 10 oclock and gave orders to Col Harmon to prepare teams for Laharp by daylight and then went home and returned to the marquee about 12 oclock and stayed till morning.
