[Hosea Stout Diary] Monday Sept. 20th 1847. Sent 5 men out on guard. I was week and feeble all day.
This evening at 4 oclock the council met to here our report bout Dan Russell & other matter,
We first reported the affair of killing Mc[.] Causlins calf and then several other things which had taken place which had created more or less excitement. This was done in order for the council to hear both sides of the case.
We then commenced on Russells case and he flatly denied the most essential points of the case and said that he could prove his assertions by his family & some others who were present.
The council was detained till near dark when Gardner, growing impatient as his contradicting him at last stated that he had lied and that this was not only the first nor the second but the third or the fourth lie that Russell had told and he could prove it, To which Russell only replied that what he said was pretty steep
President Harriss then arose and said that one of their number had here been charged with lieing and he moved for an adjournment to morrow at 2 oclock and then have Gardner prove his assertions or acquit Russell of any sencure which was agreed to
